对一起先后6次鉴定、5次判决医疗纠纷案例的思考

摘　　要：某患者住院期间病情突然恶化抢救无效死亡,之后发生医疗纠纷。该案先后经3次医学会医疗事故技术鉴定,3次司法鉴定机构医疗损害鉴定,产生多种不同结论。诉讼经过一审、二审、重审、再审、终审先后5次裁判,前后历时5年余,案件方得以了结。结合此案,就医疗事故鉴定和医疗损害鉴定的关系,鉴定机构是否可以接收一方当事人委托,鉴定分析意见依据不足、鉴定结论如何采信,如何统一医疗损害鉴定体制等问题进行分析讨论。A certain patient died during hospitalization and a medical dispute occurred after his death.The case has been appraised for medical malpractice three times by the Medical Association and three times for medical damage appraisal by judicial appraisal institutions,resulting in a variety of different conclusions.After the litigation,there were five judgments in the first instance,second instance,retrial,and retrial.It lasted more than 5 years before the case was understood.In combination with this case,regarding the relationship between medical malpractice appraisal and medical damage appraisal,whether the appraisal agency can accept the entrustment of one party,the insufficient basis of appraisal analysis opinions,how to adopt appraisal conclusions,how to unify the medical damageappraisal system,etc.,talkabout personal opinions.
