摘　　要：刑事类案裁判规则作为刑事指导性案例的核心部分,在实现法律的统一适用和类案的同质化处理方面具有特殊意义。刑事类案裁判规则的提炼主要基于疑难案件的客观存在、罪刑法定的内在要求以及权威依据的效力保障。通过对刑事案件的选取、确定刑事案件的争议焦点以及对刑事类案裁判规则的功能进行分析,能实现对刑事类案裁判规则中的事实解释规则和法律适用规则的有效提炼,将刑事案件转化为指导性案例。Criminal sentencing rules,as a core component of criminal guiding cases,hold special significance in achieving the uniform application of the law and the standardized handling of similar cases.The extraction of criminal sentencing rules is primarily based on the objective existence of difficult cases,the inherent requirements of legality in crime and punishment,and the effectiveness of authoritative references.Through the selection of criminal cases,determination of the disputed focal points in criminal cases,and analysis of the functions of criminal sentencing rules,the effective extraction of factual interpretation rules and legal application rules within criminal sentencing rules is achieved,thereby transforming criminal cases into guiding cases.
