摘　　要：毒品法庭制度的创新在于对毒品犯罪和成瘾医学的深入研究后发现犯人与病人身份的识别与融合,并在“病犯”身份引导下,以医疗戒治为中心,透过合作式司法程序为其提供良好的社会化处遇。在充分发掘毒品法庭制度的内涵和运行机理的基础上,揭示刑事政策变迁背后的价值导向,并从制度构造上提出思考。以期在我国现行刑事司法制度的内部调整之下,建构本土化的毒品法庭制度,以解决我国日趋严重的毒品犯罪问题。The innovation of the drug court system lies in the in-depth study of drug crime and addiction medicine,the identification and integration of prisoners and patients,and under the guidance of the identity of “sick prisoners” and based on the medical treatment needs,good social treatment are provided through the cooperative judicial process.On the basis of fully exploring the connotation and operating mechanism of the drug court system,the value orientation behind the changes in criminal policy is revealed and reflections on the structure of the system is put forward.The aim is to construct a localized drug court system under the internal adjustment of China's current criminal justice system,so as to solve the increasingly serious drug crime problem in China.
