摘  要:我国《民法典》《妇女权益保障法》(修订案)明确规定夫妻共担未成年子女养育等家务劳动,离婚时对家务劳动付出较多的一方应当予以经济补偿。这些规定回应了我国大多数女性身负家庭与职业双重负担之现实,力图在立法上矫正传统的家庭分工,实现家庭内部的分配正义与矫正正义,对于促进两性平等发展,保护女性平等权益有重要意义。目前,相关法律规定在具体司法实践方面,仍有待明晰和完善。本文从社会性别平等理论视角分析了女性获取家务劳动合理补偿的法理依据,论证女性负担生育照料子女等家务劳动具有社会再生产之重要价值以及对其在离婚时予以合理补偿的正当性,进而提出具体的完善建议:扩展离婚后提出家务劳动补偿请求权的期限,同时明确家务劳动的估算办法,借鉴统计学公式,计算出实然家务劳动承担数量与应然承担部分之差,再结合家庭具体情况作出合理补偿。China’s Civil Code and Law on the Protection of Women’s Rights and Interests clearly stipulate that couple share domestic labour such as raising minor children,and the party who pays more housework should be paid economic compensation when divorce.These regulations respond to the reality that most women in China bear the double burden of family and occupation,and try to correct the traditional family division of labor in legislation,and realize the distributive and corrective justice within the family,which is of great significance for promoting the equal development of both sexes,particularly for women’s interests.However,the relevant legal provisions still need to be clarified and improved in the judicial practice.Therefore,The paper analyses reasonable compensation legal basis from the perspective of social gender equality theory,proves women’s value of social reproduction housework,and puts forward the concretes suggestions:extending the deadline of housework compensation claim after divorce,clarifying the estimation method of housework,figuring out the the difference between the actual amount of household chores undertaken and the portion that should be undertaken by statistical formula,in combination with the family’s specific situation,and making reasonable compensation.
