论党内法规秩序价值的基本内涵及构建路径

摘　　要：秩序是法所要实现的重要价值之一,党内法规作为中国共产党管党治党的制度实践,亦是法的一种基本形式,同样具有秩序价值。党内法规秩序价值的本质是党的统一意志,与党的宗旨和使命息息相关,具有价值位阶的基础性、价值标准的严格性和价值实现的自发性三个特征。首先,从其价值发挥作用的逻辑顺序来看,党内法规的内在秩序价值在于指导党内法规的制定和实施,从而构建严密的党内秩序。党内法规的外在秩序价值是通过党内秩序向社会秩序的价值延伸,进而构建公平正义的社会秩序。研究党内法规的价值,首先需把握党内六种秩序,即政治秩序、组织秩序、监督秩序、党群秩序、工作秩序以及生活秩序的内在逻辑。其次,通过内部控制的方式,正确处理民主和集中、决策和执行、汇报和批准、监督和问责四个方面的关系,实现构建党内秩序的目标。最后,党内法规在引导社会发展方向的基础上,通过党领导立法、保证执法、支持司法、带头守法来规范国家机器的运行,实现社会秩序。Order is one of the significant values that law aims to realize.Intraparty rules and regulations,as an institutional practice of governing and administering the Party,represent a fundamental form of law,also possessing the value of order.The essence of the order value within intraparty rules and regulations lies in the unified will of the Party,closely tied to the Party's objectives and mission,encompassing three distinctive characteristics:the foundational nature of its value hierarchy,the strictness of its value standards,and the spontaneity of its value realization.From the logical sequence of its value application,the inherent order value of intraparty rules and regulations resides in guiding the formulation and implementation of these regulations,thus establishing a stringent intraparty order.The external order value of intraparty rules and regulations is achieved by extending the value of intraparty order to social order,thereby fostering a just and equitable social order.To realize the order value of intraparty rules and regulations,it is necessary to comprehend the intrinsic logic of the six types of intraparty orders:political order,organizational order,supervisory order,party-community order,work order and daily-life order.Subsequently,by employing internal control methods,accurately addressing the relationships between democracy and centralization,decision-making and execution,reporting and approval,as well as supervision and accountability,the immediate goal of building order inside the Party can be achieved.Lastly,building upon its guidance of societal development direction,intraparty rules and regulations regulate the operation of the state apparatus and achieve social order through the Party's leadership in legislating,ensuring law enforcement,supporting the judiciary,and taking the lead in law-abiding.
