摘 要:流域协同治理是生态文明建设的重要议题,实践历程较长。从实务角度考察,流域协同治理目前存在流域协同立法、流域协同司法、流域协同执法三种具体模式。单一适用某一种治理模式存在着立法狭窄化、同案不同判、执法无依据等问题。“一体化”治理强调将三种模式同步、综合利用,以规避问题,发挥系统治理优势。在“一体化”治理视域下,协同司法、协同执法推动立法范围的科学划定;协同立法、协同执法保障同案同判目标的实现;协同立法、协同司法保障执法过程的有法可依与有法必依。“一体化”治理为流域良法善治目标的实现提供了一种可能。Basin collaborative governance is an important issue of ecological civilization construction,and has a long practical process.From the practical point of view,there are three specific modes of basin collaborative governance:basin collaborative legislation,basin collaborative law enforcement and basin collaborative justice.There are problems in the three governance models,such as narrow legislation,different judgment of the same case and no basis for law enforcement.“Integrated”governance emphasizes the simultaneous and comprehensive utilization of the three modes,so as to avoid problems and give full play to the advantages of system governance.Under the perspective of“integrated”governance,coordinate justice and law enforcement to promote the scientific demarcation of the legislative scope;coordinate legislation and law enforcement to guarantee the realization of the target and the same case and judgment.“Integrated”governance provides a possibility for the realization of good law and good governance in the river basin.
