摘 要:近年来涉罪企业不断增多,刑事合规的建立为企业提供了事前预防机制,而事后补救机制则需要完善单位自首立功制度。当前单位立功制度处于“既无法条也无解释”的尴尬处境,建立单位立功制度不仅体现了刑法原则,也体现了宽严相济的刑事政策。文章对单位立功制度的正当性进行了证成,分析了现行立功制度构成要素,对单位立功和自然人立功进行了比较,并讨论了单位立功后效力归属的问题,以期构建行之有效的单位立功制度,从而拓宽企业轻罪路径,更好地保护企业发展。In recent years,the number of enterprises involved in crimes has been increasing.The establishment of criminal compliance provides enterprises with a preventive mechanism beforehand,while the remedial mechanism afterwards needs to improve the system of voluntary surrender and meritorious service.At present,the unit meritorious service system is in an embarrassing situation of"no explanation".The establishment of the unit meritorious service system not only embodies the principle of criminal law,but also embodies the criminal policy of combining leniency with severity.This paper proves the legitimacy of the unit meritorious service system,analyzes the elements of the current meritorious service system,compares the unit meritorious service with the natural person meritorious service,and discusses the issue of the attribution of effectiveness after the unit meritorious service,with a view to building an effective unit meritorious service system,thus broadening the path of enterprise misdemeanor and better protecting the development of enterprises.
