摘　　要：摆正价值判断在司法裁判中的位置,应认识到价值判断既不是越多越好,也不是越少越好,而是应在合适的场合发挥其应有的功能。价值的来源有法律内价值与法律外价值之别,价值判断包含根据价值的判断和对价值本身的判断。价值判断固然重要但并不能直接作为裁判的根据,而应借助于其他方法来影响判决。价值判断具有鲜明的后果主义导向,基于法外价值所进行的后果推理会侵蚀裁判的法律性,极易走向依法裁判的对立面。唯有坚持一种整体的法体系观,才能较好地协调价值判断与依法裁判之间的紧张关系,使得价值判断更好地促进依法裁判。To correct the position of value judgment in judicial judgment,it should be recognized that value judgment is neither the more the better,nor the less the better,but should play its due function in appropriate occasions.According to the source of value,there are differences between value within the law and value outside the law.Value judgment can be divided into judgment based on value or judgment of value itself.Although value judgment is important,it cannot be directly used as the basis for judgments,it should work with other legal methods to influence the making of judicial decision.Value judgment has a distinct consequential orientation.Consequential reasoning based on the extra-legal values will erode the legality of judgment and easily move towards the opposite of judgment according to law.Only by adhering to a holistic view of legal system can we better coordinate the tension between value judgment and adjudicate according to law,so that value judgment is to better judge according to law.
