国家对农村集体经济监管的法律责任

摘　　要：农村集体经济与国家权力在社会主义框架之内的法律关系决定了国家必须承担对农村集体经济的监管责任。首先,农村集体经济的公共性决定其需要国家监管;其次,社会主义对国家权力的要求也决定了国家应当对农村集体经济进行监管以推动农民在社会主义集体中的社会化与组织化。国家对农村集体经济监管受到社会主义理论及国家公权力行使这两大因素的深刻影响。国家对农村集体经济的法律监管制度存在缺陷,加之农村集体经济政策导向偏重于农民富裕而较少关注集体经济组织发展,导致国家对农村集体经济监管相对虚化。完善国家对农村集体经济的监管体系应包括监管方式、监管内容以及以相应的法律责任追究等。需要完善包括宪法在内的相关法律制度,从而形成以国家作为“总监管人”的完善监管法律体系。The legal relationship between the rural collective economy and state power within the socialist framework results in the state having to undertake the responsibility for the regulation of the rural collective economy.First,the natural and social attributes of the rural collective economy determine that it needs state regulation;Secondly,socialism's requirement for state power also determines that the state should regulate the rural collective economy to promote the socialization and organization of farmers in the socialist collective.The state regulation of the rural collective economy is influenced by the socialist theory and the exercise of the state public power.Deficiencies in the State's legal regulatory system for the rural collective economy,coupled with the fact that the policy orientation of the rural collective economy favors the prosperity of farmers and pays less attention to the development of collective economic organizations,have led to a relative deflation of the State's regulation of the rural collective economy.Improvement of the State's regulatory system for the rural collective economy should include the method of regulation,the content of the regulation,and the corresponding legal accountability.It is necessary to complete the relevant legal system including the constitution,to form a perfect regulation legal system with the state as the“general regulator”.
