网络黑恶势力的刑事法律意涵探析

摘　　要：随着信息网络技术的广泛应用,利用信息网络实施的黑恶势力犯罪在“组织结构、逐利目的、行为方式、危害作用范围”等方面出现了新变化,一定程度上对刑法规范体系造成了冲击。在揭示传统黑恶势力犯罪与网络黑恶势力犯罪之间存在包容与被包容关系的基础上,肯定现有规范体系的适用性。同时,针对网络黑恶势力犯罪的类型构造和特征变化,应在刑法解释层面进行适度拓展,使其能够及时有效回应网络黑恶势力犯罪的新情况。With the extensive application of information network technology,crimes committed by the‘black and evil forces’using information network or any means of IT have seen new changes in“organizational structure,profit-seeking purpose,behavioral pattern,and scope of harmful effects”,which,to a certain extent,has dealt quite an impact on the criminal law system.On the basis of revealing the inclusive relationship between crimes committed by traditional‘black and evil forces’and those committed by online‘black and evil forces’,the applicability of the existing criminal system is affirmed.At the same time,in view of the changes in the type&modality and in the characteristics of crimes committed by online‘black and evil forces’,the interpretation of criminal law should be moderately expanded in scope and level so that it can respond to the new situation of combatting crimes committed by online‘black and evil forces’in a timely and effective manner.
