摘 要:国有企业法律人员诉讼维权应注意的问题包括内部发案单位不配合、辅助出庭人员不了解情况、举证难度较大、个别律师事务所不易驾驭、法律人员人身安全受到威胁等。深层次的原因包括发案单位存在消极思想,发案单位辅助出庭人员责任心不强或资历较浅,年代久远、机构改革、人员流动导致证据灭失,个别外聘律师自视较高,以及部分当事人法治观念淡漠、极个别当事人可能会有精神障碍等。法律人员应采取的对策包括:掌握技巧,借力发力;深挖细刨,做足功课,教育辅助出庭人员;利用好现有资源,尽量收集证据;自尊自信,不迷信大律师的金字招牌;时刻保护自身安全等。Challenges faced by legal personnel in state-owned enterprises during litigation and rights protection include lack of cooperation from internal reporting units,inadequate understanding by supporting personnel appearing in court,difficulty in presenting evidence,challenges in managing certain law firms,and threats to the personal safety of legal personnel.Deep-seated reasons involve negative attitudes within reporting units,lack of responsibility or experience in supporting personnel,evidence loss due to prolonged periods,organizational reforms,and personnel turnover.Legal personnel should adopt strategies such as mastering skills,conducting thorough research,educating supporting personnel,utilizing available resources,safeguarding their own safety,and avoiding blind trust in prestigious law firms.
