摘　　要：随着经济全球化的快速推进和农业科技水平的提高,国际农业知识产权保护呈现出复杂的发展格局。我国作为适用UPOV公约1978年文本的成员国,目前正面临着强化育种者权利的1991年文本的直接压力。我国应在实用主义学说和利益平衡、惠益分享及社区发展理念的基础上,发掘农民权利在促进种质资源保护和构建国际种质资源利用秩序上的重要价值,并探索相应的发展保护模式,建立知情同意、信息来源披露和惠益分享机制,采用法制宣传教育、建立长效管理机制、设立免费服务权等措施做好权利落实保障,构建具有中国特色的农业遗传资源保护制度。With the rapid advancement of economic globalization and the improvement of the level of agricultural science and technology,the protection of international agricultural intellectual property rights has shown a complex development pattern.As a member state of the 1978 Act of the UPOV Convention,China is currently under direct pressure from the 1991 Act,which strengthens the rights of breeders.On the basis of pragmatic doctrines and the concepts of balance of interests,benefit-sharing and community development,China should explore the important value of farmers’rights in promoting the protection of germplasm resources and building an international order for the utilization of germplasm resources,and explore corresponding development and protection models;Establish mechanisms for informed consent,disclosure of sources of information and benefit-sharing;And the use of legal publicity and education,establish a long-term management mechanism,the establishment of free service rights and other measures to do a good job in the implementation of rights to ensure,the construction of agricultural genetic resources protection system with national characteristics.
