摘　　要：网络安全的国家治理建立在社会自治失灵所提供的合法性基础之上,并表现出既强调国家作用也倡导社会协作的新国家主义取向。然而规制的强化再次引发了对于国家权力过度膨胀的忧虑,表现为当下网络安全治理领域风险话语的流行,泛安全化危险的暴露,泛行政化与泛政治化风险的出现,以及法律明显的精细化和前置化趋势,网络安全不同领域的权力分配也遭遇了失衡风险,如此便在规制需要与过度规制之间产生了网络安全治理的诺斯悖论。均衡国家主导作用的关键在于培育自主的能动社会,应通过充分的公权信息披露,社会对国家在治理与政治参与两方面的反向建构,以及负责企业和理性公民的培育,来实现强国家与强社会的正和博弈,进而实现善治。The national governance of cybersecurity is based on the legitimacy provided by the failure of social governance,and shows a new statism orientation emphasizing the role of the state as well as social cooperation.However,the strengthening of the regulations on cybersecurity has once again raised concerns about the excessive expansion of state power,which shows in the current prevalence of risk discourse regarding cybersecurity,such as the revelation of the risk of pan-security,the emergence of the pan-adminisration and pan-politicization,as well as the obvious trend of legal refinement and pre implementation,and even the imbalanced distribution of power in different fields of cybersecurity.Then the North Paradox of cybersecurity governance arises between the need for the state’s regulation and the possible excessive regulation.The key to balancing the leading role of the state is to cultivate an autonomous and dynamic society.The correct goal and good governance of strengthening our country and society should be achieved through enough information disclosure of public power,reverse construction of the national governance and political participation by society,and the cultivation of responsible enterprises and rational citizens.
