摘  要:数据可携带权是欧盟为增强数据主体对其个人数据的控制和转移、打破数据壁垒而提出的一项新兴权利。其既有个人信息的基本权利属性,又蕴含着竞争附随效应,对市场竞争有正反两方面影响。我国数据可携带权因其权利客体模糊、权利行使缺陷及实施过程中带来的权益冲突、技术障碍等因素,陷入可操作性弱的困境,长此以往将不利于数字经济市场竞争的进一步发展。对此应在坚持我国现有法律框架的前提下,构建个人信息法保护和竞争法规制的双重路径;明晰权利客体构造和权利行使边界;针对性地解决技术局限,规范数据格式;构建起权利救济、行政监管、协同参与的配套机制。Proposed by the EU,the right to data portability is an emerging right to enhance the control and transfer of data subjects over their personal data as well as breaking down data barriers.It has both the basic right characteristics of personal information and the competitive attachment effect,which has both positive and negative effects on market competition.Right to data portability is in a difficult situation of weak operability due to its ambiguous object of rights,defects in the exercise of rights and the conflict of interests and technical barriers in the implementation process,which will be very unfavorable to the further development of market competition in the digital economy in the long run.In this regard,the dual path of personal information protection law and competition law should be constructed under the premise of adhering to the existing legal framework in China.The structure of the right object and the boundary of the right exercise should be clarified.The technical limitations and standardizing the data format in a targeted manner should be addressed and a supporting mechanism of right remedy,administrative supervision and collaborative participation should be built up.
