摘　　要：我国当下的农村土地征地补偿实践存在征地补偿主体权责错位、补偿主体混乱、公共利益界定不明、村民会议虚置、法律救济渠道狭窄、补偿分配和管理缺乏制度支撑的困境,其根源在于农村土地发展权缺失、农民权益保障不足、农村集体土地所有权主体缺位等长期存在的难题。农村征地的动态性和复杂性决定了需从理论上对该领域的司法实务作进一步探讨。在征收补偿的过程中,国家应以积极主动的态度监督和介入,着力纠正各级政府在政策执行中的偏差,不应缺位和失语。未来的征地补偿司法实践,需彰显征地补偿的财产价值取向,保障民众的土地权益,贯彻市场补偿原则,完善征地纠纷解决机制,构建分类、多元的权利救济机制,在制度设计、程序执行上切实保障农民发展权。The current practice of rural land acquisition compensation in China faces difficulties such as misplacement of the rights and responsibilities of the compensation subject,confusion of the compensation subject,unclear definition of public interests,absence of village meetings,narrow legal relief channels,and a lack of institutional support for compensation distribution and management.The root causes are the lack of rural land development rights,insufficient protection of farmers'rights and interests,and the absence of rural collective land ownership subjects.The dynamic and complex nature of rural land acquisition requires further in-depth exploration of judicial practice in this field from a theoretical perspective.In the process of collecting compensation,the state should adopt a proactive attitude of supervision and intervention,focus on correcting the deviation of governments at all levels in policy implementation,and should not be absent or speechless.In the future judicial practice of land acquisition compensation,it is even more necessary to highlight the property value orientation of land acquisition compensation,protect the land rights and interests of the people,implement the compensation principles in the market,improve the mechanism for resolving land acquisition disputes,build a classified and diverse rights relief mechanism,and effectively protect the development rights of farmers in system design and program execution.
