我国目前行政伦理的困境及化解办法

摘　　要：在逻辑实证主义、公共选择理论、工具理性等思潮的影响下,当前行政部门的决策对于效率和经济的追求远超对于公共精神和公共价值的追求,从而损害到社会的公平、公正、弱势群体利益和本应承担的代际责任。针对我国目前面临的行政伦理规范体系建设缺失、行政伦理有效落实困难、行政伦理中公平公正受损以及现实与公民期待差距较大的困境,提出了树立公民精神、服务人民和爱国主义的行政伦理理念,构建德法双重保障的行政伦理规范体系,加强行政过程中伦理层面的监控,以公民参与和可控行政自由裁量权促进行政伦理落实的化解办法。Under the influence of logical positivism,publice choice theory and instrumental rationality and other ideological trends,ad-ministrative departments in decision-making pursue far more fficiency and economy than its own public spirit and public value,which damages social fairness,justice,the interests of vulnerable groups and the intergenerational responsibility that should be borme.In response to the current lack of normative system construction,diffculties in effective implementation of administrative ethics,damage to fairness and justice in administrative ethics,and the significant gap between the reality of administrative ethics and citizen expectations,the author puts forward the idea of building the citizen spirit,serving the people and patriotism,and suggests to set up normative system of administrative ethics of double guarantee of morality and law and strengthen the supervision of the ethical level in the administative process,with the citi-zen involvement and controllable administrative discretion to promote the implementation of the solution to administrative ethics.
