我国检察专业体系建设理论与实践研究

摘　　要：近年来,我国司法体制改革、监察体制改革、刑事诉讼制度改革等重大改革举措接续推进、叠加聚合,检察机关以往依托内设机构部门的检察专业体系已经无法一贯到底,难以适应当下实践需要,也给检察权的微观运行造成一定阻碍。将马克思主义社会分工理论作为检察专业体系建设的逻辑起点,按照社会分工发展规律的专业化要求,明确以专业体系建设为基础的检察工作专业化发展方向。同时,借鉴高校学科体系、医疗专业体系的分类规律和运行模式,研究检察专业体系的专业分类依据,确定分类的基本范畴、分类方法、分类导向。由此,结合检察工作实际,从人员分类专业化、业务办理专业化、管理制度专业化方面探索构建检察专业化工作格局,以期为新时代中国特色社会主义检察权力科学配置运行,提升权力制约与监督效能提供些许借鉴。Recently,the reform of judicial system,supervision system reform,criminal procedure system reform,other major reforms have been carried out continuously in China.The procuratorial professional system relying on the interal institutions is unable to satisfy the present practice needs,which actually impedes the operation of the procurational power.This study takes Marxist theory of social division of labor as the logical starting point of the construction of procuratorial professional system.According to the specialized requirements of the development law of social division of labor,the study confirms the professional development direction of procuratorial work which based on the construction of professional system.At the same time,referring to the classification law and operation mode of the discipline system of universities and the medical professional system,the study focuses on the professional classification basis of the procuratorial professional system to determine the basic category of classification,classification methods and guidance.Finally,combining with the actual procurato-rial work,the study explores the establishment of the professional patterm of procuratorial work from the perspective of specialized personnel classification,operation and management system so as to provide scientific allocation and operation of procuratorial power with Chinese characteristics in the new era and improve the efficiency of power restriction and supervision.
