摘 要:公共信用综合评价整合了多领域的公共信用评价,既是信用主体决策的有效信息,又是国家提高规制能力的新型工具。但在实践中,公共信用综合评价尚未找准其制度定位,也未厘清与其他信用监管手段之关系,而且在信息采集、信用评价和评价应用等环节存有潜在的法律风险。目前,完善公共信用综合评价应从其制度功能和约束条件出发,应用类型化和成本收益分析的方法,明确公共信用综合评价的法律定位;同时,通过实体约束、程序控制和事后救济等法律途径,提高其治理成效。The comprehensive evaluation of public credit integrates the public credit evaluation of multiple fields.It’s not only the effective information for the decision-making of credit subjects,but also the new tool for the state to improve the regulatory ability.However,in practice,the public credit comprehensive evaluation has not yet identified its institutional positioning,nor has it clarified its relationship with other credit regulatory tools.And there are potential legal risks in the links of information collection,credit evaluation and evaluation application.At present,to improve the comprehensive evaluation of public credit,we should start from its institutional functions and constraints,apply the methods of typing and cost-benefit analysis,and clarify the legal orientation of comprehensive evaluation of public credit.At the same time,the effectiveness of its governance can be improved through legal means such as entity constraint,procedure control and relief afterwards.
