外观设计侵权判断的困境与出路——对外观设计“整体视觉效果”侵权判断方式的反思

摘　　要：“整体视觉效果”侵权判断方式是各国或地区在外观设计侵权中普遍采用的方式。其一方面沿袭了混淆理论的基本框架,另一方面承载着保护设计创新的制度需求。为保护设计创新,这种侵权判断方式需要不断进行修正,从而导致侵权判断逻辑扭曲。尽管如此,保护设计创新的制度需求依然难以完全实现,遑论这种侵权判断方式主观性强,结果难以预见。鉴于外观设计的表达属性,版权实质性相似侵权判断方式为此提供了值得探讨的解决路径。The"overall visual effect"test is commonly adopted in countries or regions in design infringement judgement.On the one hand,it inherits the framework of the confusion theory,and on the other hand,it carries the basic demand of protecting design innovation.In order to protect design innovation,this infringement test has been constantly under amendment,resulting in the distortion of the logic of infringement judgment.Nevertheless,it is still difficult to fully realize the basic demand of protecting design innovation,not to mention that the test is highly subjective and the result is difficult to foresee.In view of the expressive attributes of the design,the substantial similarity test in the copyright area might be introduced into the design infringement judgement to solve the difficulties.
