摘　　要：加快发展方式绿色转型是全面建设社会主义现代化国家的重大举措。党的二十大报告指出,尊重自然、顺应自然、保护自然是全面建设社会主义现代化国家的内在要求。渔业行政处罚作为渔业资源可持续发展的重要保证,需要准确把握“过”和“罚”的尺度,明确渔业行政处罚中过罚相当原则的适用边界,要从行政处罚的目的、行为的危害性评价及违法者的主观认识方面对“过”加以明确。针对违法行为发生竞合的情形,应结合渔业行政处罚裁量基准和渔业法基本制度原则,遵循择一重罚、首违不罚和以比例原则确定处罚的种类和额度。Accelerating the green transformation of development is a major initiative to comprehensively build a socialist modern country.The report of The 20th Party Congress of the Communist Party of China pointed out that respecting nature,conforming to nature and protecting nature are the inherent requirements of comprehensively building a socialist modern country.As an important guarantee for the sustainable development of fishery resources,it is necessary to accurately grasp the scale of"fault"and"penalty",and clarify the boundary of the application of the principle of equivalent penalties in fishery administrative punishment,in terms of the purpose of administrative punishment,the evaluation of the harm of the act and the subjective perception of the offender.The"fault"should be clarified in terms of the purpose of administrative punishment,the evaluation of the harm of the act and the subjective understanding of the offender.In the case of competing violations,the types and amounts of punishment should be determined in accordance with the principles of the basic system of fisheries law and the principles of choosing one heavy penalty,first violation and proportion.
