摘　　要：担保物权的竞存是在担保物权的种类、公示方式、担保财产等因素的共同作用下产生的,且在适用中存在不同类型的权利竞存。当多个动产和权利担保物权出现竞存时,若无特别规定,应遵循“公示在先,权利在先”的一般规则。对于特殊类型的担保物权,应当结合担保物权的表现形式和生效要件作特别考虑。在善意取得场合,为维护交易安全、保护第三人信赖利益,善意取得的担保物权的顺位应优先于在先的其他担保物权。在动产和权利担保物权顺位规则中,应当采取“一般规则—特殊规则”双重结构。The coexistence of security interests is formed under the joint influence of factors such as the types of security interests,methods of publicity,and secured property,and different types of rights coexist in its application.When multiple security interests in movables and rights co-exist,without special statutory requirements,according to Article 414 and Article 415 of the Civil Code,the rule of“first perfect,first right”shall be applied.For special types of security interests,special considerations should be made based on the manifestation and effective requirements of the security interests.In the case of bona fide acquisition of security interests,in order to maintain transaction safety and protect the interests of third parties,the security interests established as a result of bona fide acquisition has priority over other pre-existing security interests.In the priority rules of the security interests in movables and rights,a“general rule-special rule”dual structure should be adopted.
