“共犯独立性”视域下帮助信息网络犯罪活动罪中“明知”的认定

摘　　要：计算机技术的迭代发展建构起了一个与现实物理空间完全不同的空间——虚拟互联网空间,此空间内的帮助行为因互联网的特殊属性而发生了异化,呈现出帮助对象不固定、帮助者与受助者意思联络趋弱或无意思联络、帮助行为独立化程度高等特点。面对这一变化,以共犯从属性说为根基的“量刑规则说”或“帮助行为正犯化说”均难以对网络帮助行为的可罚性作出合理解释,只有坚持共犯独立性说,对行为人的犯罪情节进行独立的刑法评价,并将行为人对自身行为效果的认知作为认定主观故意的唯一根据,再通过制定具体的推定规则以审查意思联络较弱时的“明知”,才能解决司法实践面临的困难。The intergenerational development of computer technology has built a space completely different from the real physical world-virtual Internet world. The aiding in this space has been alienated due to the special attributes of the Internet, showing the characteristics of unfixed help objects, weak or meaningless connection between the helper and the recipient, and aiding's high degree of independence. In the face of this change, wether“the theory of sentencing rules”or“the theory of separate legalization of aiding crime”based on the princple of Subordinate of Complicity are both difficult to make a reasonable explanation of the punitive nature of network criminal aiding. The only way to do this is to adhere to the theory of independence accomplice, conduct an independent criminal law evaluation of the perpetrator's criminal circumstances, and take the cognition of the perpetrator's own behavior effect as the only basis for determining the subjective intent, Then we can solve the difficulties faced by judicial practice by formulating specific presumption rules to review the“knowing”when the will contact is weak.
