摘　　要：李大钊的法律之缘,贯穿于他的一生。革命家和马克思主义理论家,是李大钊的人生主色调,而法律和法学则是他政治实践和政治理论的一个底色。探寻李大钊法理学思想,是法学研究者的一个重要使命。李大钊的法理学思想形成有一个历史发展的过程,从民主主义法学转变为共产主义法学:从启蒙主义角度出发,他提出了“法律民彝论”,兼顾中西、追求民主和法治,开创了独具特色的法理学;从唯物史观出发,他批判和继承了西方政治与法律思想史,继承和发展了共产主义从空想到科学的法律学说,从马克思的经典中提炼出唯物史观的法律一般理论,阐明了马克思主义法理学。李大钊对法律与权力、法律与道德的专题研讨,对政治权力合法性与正当性的论证,充分显示了他的理论创见。李大钊是早期共产党人中善于充分吸取外来法学理论资源的理论先驱,也是探索构建中国法理学自主知识体系的思想先驱。Li Dazhao’s legal serendipity has been throughout his life.He is well known as a great revolutionist and Marxist.Meanwhile,he is good at legal theory and law history.His political practice and theory have a legal background.Exploring Li Dazhao’s jurisprudence is an important mission for legal researchers.The formation of Li Dazhao’s legal thought underwent a gradual process:from democratic to communist jurisprudence.From the perspective of Enlightenment,he proposed the legal theory of MINYI.He integrated China and the West,pursuing democracy and rule of law.From historical materialism,he dialectically reflected on Western political and legal thought,completing communist jurisprudence from utopia to science.He extracted the general theory of law from the classics of Marxism.The discussions on law and power,on law and morality,and on legitimacy of political power demonstrated his theoretical creativity.Li Dazhao was a pioneer among early Communists who were adept at reviewing foreign legal resources and constructing independent knowledge system on Chinese ju⁃risprudence.
