基层治安治理中的“情治”逻辑及当代价值

摘　　要：情感治理作为中国基层社会治理的重要组成部分,兼具治理对象和治理手段的双重属性,是适用于当代基层治安治理的一种范式革新。情感治理深刻依附于传统中国乡土场域之中,具有深厚的文化基础、政治基础和社会基础,映现出中国传统社会治理模式中所内蕴的情感脉络。传统乡土中国的情感治理主要从乡村共同体的情感搭建、基本生产生活单元的情感塑造和乡里个体的情感锤炼三个层面展开,将基层百姓纳入礼法秩序并使其共同参与构建基层治安治理结构。情感治理嵌入当下基层治安治理实践,需要调和柔性情感与工具理性之间的张力,培育以“人”为核心的社会化、制度化情感,推进治理共同体由松散连结向有机团结转变,激活教化功能以平衡情感供需关系,弥补社会结构变化带来的治理缺陷,实现基层治安治理的精细化、规范化和人文化。As an important component of grassroots social governance in China,affective governance has the dual attributes of governance object and governance means,and is a paradigm innovation applicable to contem⁃porary grassroots public-security governance.Affective governance is deeply attached to the traditional Chinese rural field,has profound cultural,political,and social foundations,and reflects the emotional context embedded in the traditional Chinese social governance model.The affective governance of rural China is mainly carried out from three levels:the affective construction of rural community,the affective shaping of basic production and living units,and the affective refining of rural individuals.The grassroots people are brought into the ritual and legal order and jointly participate in the construction of the grassroots public-security governance structure.It is required for the involvement of affective governance in the current practice of grassroots public-security governance to reconcile the tension between flexible affection and instrumental rationality,to cultivate social⁃ized and institutionalized“people-centric”affections,to promote the transformation of governance community from loose connection to organic solidarity,and to activate the function of edification to balance affective supply and demand,in order to make up for governance defects brought about by changes in social structure and to re⁃alize the refinement,normalization,and humanization of grassroots public-security governance.
