摘　　要：我国现行法律规范中行政处罚发挥着确保行政义务履行的功能,以罚代管机制正是行政处罚确保义务履行的制度体现。行政处罚确保义务履行的立法选择,一方面源于我国行政强制执行制度承载能力的不足,另一方面与行政处罚的制度特性和风险社会干预前置的社会需要相适应。行政处罚确保行政义务履行,应当理解为行政处罚事前预防功能的一种表现形式。行政处罚确保义务履行的制度设计应该有所节制,从实体上看应该受到基础义务范围、主观要件、比例原则等的约束;从程序上应该借鉴行政强制执行的有益经验,建立催告、程序转换、行政和解等制度。Administrative punishment plays a role in ensuring the fulfillment of administrative obligations in the current legal norms in China,and the mechanism of substituting punishment for management is the institutional embodiment of ensuring the fulfillment of obligations through administrative punishment.The legislative choice of administrative punishment to ensure the fulfillment of obligations is not only due to the insufficient carrying capacity of China s administrative compulsory execution system,but also adapted to the institutional characteristics of administrative penalty and the social needs of pre-intervention in risk society.Administrative punishment ensures the fulfillment of administrative obligations,which should be understood as a manifestation of the preventive function of administrative penalty in advance.The system design of administrative punishment to ensure the fulfillment of obligations should be restrained,and from a substantive perspective,it should be constrained by the scope of basic obligations,subjective elements,proportional principles,etc;From a procedural perspective,we should draw on the beneficial experience of administrative compulsory execution and establish systems such as reminders,procedure conversion,and administrative reconciliation.
