产权科层视角下集体成员权的实现机制研究

摘　　要：近年来的集体产权制度改革在拓展成员的财产性权利方面成果显著,但同时也导致了成员自益权与共益权之间的进一步分离,且使以程序性权利为主要内容的共益权陷入困境。近期公布的《农村集体经济组织法(草案)》不仅不能解决上述问题,反而会加剧问题的恶化。集体产权制度改革是多个层次间的博弈,并且各层次间形成循环往复的嵌套性关系。因此,可基于产权科层的视角,从个体、集体和国家三个层次探讨集体成员权的实现机制。即,拓展个体层的参与渠道和参与方式,并实行多元激励机制。健全集体层的决议机制和统合式监督机制。国家层的制度设计和相关立法应对集体成员的自益权与共益权、农民集体与集体经济组织等加以明确区分,并在立法中完善集体决议撤销权的相关规定,为集体成员监督权的实现提供有力保障。In recent years,the collective property right institutions reform has expanded the property rights of members,but also aggravated separation between self-interest right and common interest right,and made the common interest right featured by procedural rights into predicament.“Rural Collective Economic Organization Law(draft)” published recently not only cannot solve the above-mentioned problems,and will even aggravate the problems.The collective property right institutions reform is a game among many layers,whose relationships are nested in a cyclic way.Therefore,based on the view of property right hierarchy,the realization mechanism of membership right can be discussed from three layers of “individual-collective-state”.Namely,individual level expands the channels and ways of member's participation,and carries out the multiple incentive mechanism.Collective layer improves the collective decision-making mechanism and integrated oversight mechanism.State institutions layer makes a clear distinction between self-benefit right and common interest right,as well as between the farmer collective and the collective economic organizations,and perfects the relevant provisions of rescission right of collective resolutions in the legislation to provide a strong guarantee for the realization of members' supervision right.
