海事参与渔业船舶海上交通事故调查研究

摘　　要：《中华人民共和国海上交通安全法》规定,涉及渔业船舶的海上交通事故,渔业渔政主管部门、海警机构应当参与调查。但直到现在,海事管理机构以及渔业渔政主管部门、海警机构在如何具体实施该规定仍存在困惑。从该法修订的意义、法律原文解读、语言逻辑关系三方面剖析“参与调查”的含义,并针对实施遇到的具体问题,尝试解答如何开展涉及渔业船舶的海上交通事故调查。According to the Maritime Traffic Safety Law of the People's Republic of China,where a fishery vessel is involved in a maritime traffic accident,the competent fishery administration and the maritime police institution shall participate in the investigation.Nevertheless,the maritime safety administration,the competent fishery administration and the maritime police institution are confused about how to implement this provision in practice.This paper analyzes the meaning of"participate in the investigation"from three aspects of the significance of the revision of the Maritime Safety Law,the interpretation of the original articles,and the logical relationship of language.In view of the specific problems encountered during the implementation,it attempts to figure out how to conduct investigations into maritime traffic accidents involving fishery vessels.
