摘　　要：规制是经济法学乃至法学的常见范畴。现有的研究多聚焦于经济学视野中规制工具的选择和评价问题,而较少在政治学等多学科视野中就规制及其变化进行梳理和反思。探究规制变化的基本载体是规制体制。根据艾斯纳《规制政治的转轨》的论述,美国规制先后经历市场体制、社团体制、社会体制、效率体制这四个交替产生的规制体制时期,反差和延续并存,美国正在迈向全球规制体制时期。不过,艾斯纳宪法意识的缺位及规制变化带来的大众政治的衰落,致使规制政治的转轨呈现“无力感”。在这个意义上,“规制将会如何变化”实际上依旧是一个开放性问题。Regulation is a common category of economic jurisprudence and even jurisprudence.Existing research mostly focuses on the selection and evaluation of regulatory tools from the perspective of economics,while less combing and reflection on regulation and its changes from a multidisciplinary perspective such as political science.The basic carrier for exploring regulatory changes is the regulatory system.According to Eisner’s Regulatory Politics in Transition,American regulation has experienced four alternate regulatory regimes,namely the market system,the community system,the social system,and the efficiency regime.Contrast and continuity coexist,and it is moving towards a global regulatory regime.However,the absence of Eisner’s constitutional awareness,coupled with the decline of popular politics brought about by changes in regulation,resulted in a“feeling of powerlessness”in the transition of regulatory politics.In this sense,“how will regulation change”is actually still an open question.
