个人金融数据的法律治理及进路——基于个人金融数据双重属性视角的分析

摘　　要：个人金融数据具有复杂的双重属性,具备个人属性和财产属性交织、私人属性和公共属性并存的特点。个人金融数据法律属性的特殊性对其法律治理体系提出了更高的要求。现行个人金融数据法律治理体系未能充分应对个人金融数据的双重属性,存在数据收集失范、数据共享失序以及数据跨境流动法律规则缺位的现实困境。个人金融数据法律治理需在平衡金融消费者与金融数据控制者的数据权益基础上,赋予金融消费者以防御性法益,赋予数据控制者以特殊数据财产权予以保护。健全个人金融数据法律治理规则应以强化金融数据收集源头治理、构建类型化金融数据共享模式、规范金融数据跨境流通为进路,加强个人金融数据安全风险防范,促进金融数据要素市场健康发展。There are complex dual attributes in personal financial data,which presents the characteristics of personal attribute and property attribute interweaving,private attribute and public attribute co-existing.The particularity of the legal attribute of personal financial data puts forward stricter requirements for the legal governance system.The current legal governance system of personal financial data fails to fully deal with the dual attributes of personal financial data,and there are realistic difficulties in data governance,such as the disorder in data collection and data sharing and the absence of legal rules for cross-border data flow.On the basis of balancing the data rights and interests of financial consumers and financial data controllers,the legal governance of personal financial data should provide financial consumers with defensive legal interests and supply data controllers with special data property rights for protection.In order to strengthen the prevention of personal financial data security risks and promote the healthy development of the financial data element market,improving the legal governance rules for personal financial data should strengthen the governance of the source of financial data collection,build a typed financial data sharing model,and regulate the cross-border circulation of financial data.
