利益平衡视角下我国网络平台版权侵权责任问题分析

摘　　要：“通知-删除”规则在新技术条件下已被证实难以平衡版权各方主体利益,异化为平台逃避版权保护责任的工具。而欧盟《单一数字市场版权指令》第17条确立的版权内容过滤制度,以技术为依托,为合理配置我国网络服务提供者版权侵权责任提供了一个新方向,其对于加强平台与权利人合作、平衡二者利益关系具有重要性。我国作为互联网大国,应立足现状,理性借鉴欧盟先进立法经验,从利益平衡角度构建具有中国特色的网络服务提供者版权侵权责任配置模式。首先,应明确平台是否承担以及承担何种程度的过滤义务取决于其信息管理控制能力与过滤技术水平的高低;其次,应建立平台与权利人之间的过滤技术成本合理共担机制,防止权利滥用;最后,应设立错误过滤的救济机制,保障用户合法权益。The“notice and takedown”Rule has been proved to be difficult to balance the interests of all parties involved in copyright under the new technological conditions,and has been alienated into a tool for platforms to evade their copyright protection responsibilities.The copyright content filtering system established in Article 17 of the Copyright Directive on the Single Digital Market of the European Union,based on technology,provides a new direction for the reasonable allocation of copyright infringement liability of China’s Internet service providers,and plays an important role in strengthening cooperation between platforms and right holders and balancing the interests of the two.As a major Internet country,China should base on the current situation,rationally draw on the advanced legislative experience of the EU,and build a mode of configuration copyright infringement liability allocation of Internet service providers with Chinese characteristics from the perspective of interest balance.Firstly,it should be made clear that whether and to what extent the platform undertakes the filtering obligations depends on its information management and control ability and the level of filtering technology.Secondly,a reasonable sharing mechanism of filtering technology cost between the platform and the right holder should be established to prevent the abuse of the right.Finally,the relief mechanism of error filtering should be set up to protect the legitimate rights and interests of users.
