摘  要:法治建设除了需要诉诸法律资源的筹集之外,还应关注到儒学实践的当代再现。尤其是儒家对家庭伦理的重要性做出的阐发,原本就可以用来塑造亲属举证豁免权。家庭伦理未必只能存在于家内,甚至可以通过外溢的途径在家外获得展现,既有正面形象,又有负面形象。面对后者,公共舆论加持着其他儒学理念表达出了排斥。行为互动方面的儒学传统,更是成为公共舆论的内在构成。各种情形的出现都肇因于法律的引擎。儒学实践与法治建设共同塑造着当代的社会氛围,人们的日用常行连缀着儒学文本内外。只要把社会转型时期的断裂式思考和文化知识论转换为关联式思考和文化修养论,通过研磨具体事例即可发现,儒学对法治的参与大致遵循两种进路,即建构论和自然而然生成论。In addition to the allocation of legal resources,the construction of the rule of law also requires attention to the contemporary manifestation of Confucian practices.Particularly,the elaboration of the importance of family ethics in Confucianism can be utilized to establish relatives’immunity from evidence.Family ethics may not necessarily exist only within the home,and can even be manifested outside the home through spillover pathways,with both positive and negative images.In the face of the latter,public opinion has expressed resistance of other Confucian concepts.The Confucian tradition of behavioral interactions has become an inherent part of public opinion.These various occurrences are triggered by the engine of the law.Confucian practices and the construction of the rule of law are jointly shaping the contemporary social atmosphere,and people's daily routines are intertwined with Confucian texts.By transforming the fragmented thinking and cultural epistemology during the period of social transformation into associative thinking and the theory of cultural self-cultivation,through the examination of specific cases,it can be observed that Confucianism’s participation in the rule of law generally follows two approaches:social constructivism and spontaneous generation theory.
