经济学视角下帮助信息网络犯罪活动罪探究模式创新

摘　　要：网络诈骗等网络犯罪日益泛滥,人民的财产安全受到严重威胁。帮助信息网络犯罪活动罪的增设,有利于从根本上斩断网络犯罪利益链条。帮信罪设立后经历了沉寂到激活再到井喷的增长过程,利用成本收益模型及弹性理论分析发现,高投资回报比是该罪迅猛增长的重要原因,而帮信罪在司法适用中陷入了“缺乏弹性”困境。为有效治理帮信罪,可以从提高犯罪成本和促使帮信在实践中向“富有弹性”转变两个角度完善帮信罪防范路径。Cyber fraud and other cybercrimes are getting increasingly rampant,posing a serious threat to people's property safety.The addition of the crime of helping criminal activities related to information networks is conducive to fundamentally cutting off the chain of benefits from online criminal activities.After its establishment,this crime has experienced a growth process from dormancy to activation and then blowout.Through the cost-benefit model and elastic theory analysis,it is found that high investment return is an important factor contributing to the rapid growth of this crime,but in judicial application,this crime is facing a"inflexibility"dilemma.To effectively govern the crime of helping criminal activities related to information networks,it is imperative to improve the prevention paths from two perspectives:increasing the cost of crime and promoting the transformation of this crime towards"flexibility"in practice.
