摘　　要：以检察统一业务应用系统数据为依托,分析受案时间、简要案情、审结数额、审结罪名、一审宣告刑等“检察数字”,发现涉“两卡”类电信网络诈骗关联犯罪惩治对象多为犯罪链条末端的“卡农”,罪名集中于帮助信息网络犯罪活动罪和掩饰隐瞒犯罪所得罪,两罪不同发案时期出现同质变量、此消彼长的趋势,检视发现网络犯罪规制的刑法扩张和司法的扩大适用、电信网络诈骗关联犯罪?“主观明知”认定泛化,“客观行为”过度评价,罪名界限模糊,罪刑不适等问题。准确认定电信网络诈骗及其关联犯罪,提倡坚持形式与实质综合标准,以罪刑相适应原则进行调适的解决途径。Relying on the data obtained from Procuratorial Organs'Unified Business Application System,this study analyzes the"procuratorial data"including the time of accepting cases,the brief information related to cases,the quantity and charges for the resolved cases,as well as the sentences made by courts in the first instance.Then,it is found out that most of the offenders punished due to participation in telecom frauds involving"phone cards or bank cards"are so-called"card farmers"at the lowest level of a criminal chain.These offenders tend to be charged with crime of helping in criminal activities related to information networks or crime of concealing or hiding criminal proceeds,while two charges showing a trend of homogenous variables and vicissitudes in different periods of occurrence.The study also summarizes knotty problems in application of laws,such as the expansion of criminal provisions on network crimes and the broad application in justice,generalization in identifying"subjective knowledge"the offenders have when committing crimes related to telecom frauds,over-evaluation of"objective behaviors",the vague boundary between different charges,and the imbalance between punishment and crime.In order to accurately identify telecom frauds and related crimes,we should adhere to a comprehensive standard with equal emphasis on form and substance and abide by the principle of suiting punishment to crime.
