利用虚拟货币传销犯罪的侦查难点与讯问对策研究

摘　　要：虚拟货币传销是近年来的新型传销手段,严重扰乱了经济秩序和社会稳定。由于其犯罪行为更加隐秘、案情更加错综复杂,侦查中存在平台运营模式、犯罪分子信息和组织分工、虚拟货币流水与冷钱包位置、平台后台数据提取等许多难点难以解决。为更好地配合整体侦查工作,在充分分析传销人员心理特征的基础上,针对不同传销人员的心理特点和在传销组织中的角色分工,抓住心理弱点和心理诉求,充分与案情相结合,正确使用讯问策略,还原案件事实,解决侦查难点。Pyramid scheme using virtual currency is a new type of pyramid scheme having seriously disrupted the economic order and social stability in recent years.As its criminal behaviors are more secretive and the cases are more complex,there are many difficulties hard to be solved in the investigation process,concerning platform's operation mode,criminals'information and division of labor,virtual currency flow and cold wallet's location,as well as the extraction of platform's background data.In order to promote the overall investigation work,this study proposes the necessity to adequately analyze the psychological features of the participants,grasp their mental weaknesses and demands based on different participants'psychological characteristics and roles in the pyramid scheme organization,and then suggests correct interrogation strategies should be adopted by fully combining with the cases to restore the case facts and solve the investigative difficulties.
