摘　　要：在分析国内多种林业碳汇产权质押融资模式的基础上,认为当前林业碳汇产权质押融资在质权设立和质权实现方面存在具体法规缺失、公示制度不健全、核算评估标准不统一、质权实现途径不足、“信贷+”合作机制与风险补偿机制不完善等法律障碍。提出了从明确林业碳汇产权的法律地位和林业碳汇产权出质人责任、建立统一的核算评估体系和标准并完善登记与公示制度等方面健全林业碳汇产权质押基本法律制度;通过合力推动市场需求、多元共治减缓林业碳汇信贷风险等方式完善林业碳汇产权质押的实施机制的解决路径。Based on the analysis of a variety of domestic forestry carbon sink property right pledge financing models,this paper believed that the current forestry carbon sink property right pledge financing in the establishment and realization of the pledge was facing several problems,which including that the specific laws and regulations,defective publicity system,accounting and evaluation standards not uniform,lack of ways to realize the pledge,“credit+”cooperation mechanism and risk compensation mechanism not perfect.The legal solution to these obstacles was to improve the basic legal system of forestry carbon sink property rights pledge by clarifying the legal status of forestry carbon sink property rights and the responsibility of the pledger,establishing a unified accounting and evaluation system and standards,and improving the registration and publicity system.The second was to improve the implementation mechanism of forestry carbon sink property rights pledge by promoting market demand together and mitigating forestry carbon sink credit risks through multiple co-governance.
