网络舆论对政府依法行政的影响研究——基于36个案例的模糊集定性比较分析

摘　　要：为廓清网络舆论对政府依法行政的影响,论文建构了判别依法行政的程序框架,并通过模糊集定性比较分析法,对近五年网络舆论对依法行政产生了影响的36个案例进行分析。研究结果显示,网络舆论对政府依法行政的影响利大于弊;在网络舆论影响政府依法行政的共性机制中,政府积极回应及公共情绪相对稳定是关键驱动条件。网络的开放性和广泛参与性使网络舆论能够“越辩越明”,不仅不会形成群体极化,还有助于促进政府依法行政。未来在建设法治政府的过程中需要充分利用这些规律,通过优化政府回应态度、稳定网络舆论中公共情绪、提高政府和权威网络媒体的引导力等措施来提升我国政府应对网络舆论时的依法行政水平。To clarify the influence ofonline public opinion on law-based government administration,we construct a procedural framework for measuring whether government administration is legitimate.Then we analyze 36 cases in the past five years using fsQCA.The results show that the overall effects of online public opinion on government administration are much more beneficial than harmful."Government positive response"and"relatively stable public sentiment"play key roles in the general mechanism of online public opinion affecting law-based government administration.The high degree of online participation enables online public opinion to"debate more clearly".Online opinion does not form"group polarization".It in fact plays a positive role in promoting the construction of law-based government administration and democratic participation.The government can improve legal administration by optimizing response attitude,stabilizing public sentiment,and improving official media's ability to guide public opinion.
