关于黄河流域高质量发展综合立法的思考

摘　　要：黄河流域生态保护和高质量发展是重大国家战略。《黄河保护法》是从流域层面实施综合治理和黄河高水平保护、高质量发展、建设造福人民“幸福河”的法治保障。《黄河保护法》立法基础包括国家层面、地方层面和流域层面的立法。《黄河保护法》解决了黄河流域管理机构职权范围不明确和各省(区)法令不统一、不衔接等难题。《黄河保护法》已施行,建议尽快建设基于《黄河保护法》的法律法规框架体系,并及时对《黄河保护法》进行宣传和跟踪评估等。The ecological protection and high-quality development of the Yellow River Basin are significant national strategies.The“Yellow River Protection Law of the People’s Republic of China”provides legal guarantees for comprehensive management at the basin level,high-level protection of the Yellow River,high-quality development,and the building of a“Happy River”benefiting the people.The legislative basis of the“Yellow River Protection Law of the People’s Republic of China”includes legislation at the national,local,and basin levels.It addresses the issues of unclear jurisdiction of Yellow River Basin management institutions and the lack of uniformity and coordination among provincial regulations.The paper proposed recommendations for the prompt building of a legal framework system based on the“Yellow River Protection Law of the People’s Republic of China”and the timely promotion and evaluation of the legislation and its implementation.
