摘　　要：作为行政组织法的一项基本原则,组织效能原则的内涵和意义并未得到深入挖掘。行政任务视角的引入,有助于组织效能原则的精细化和规范性展开。行政任务是否符合“个人-市场-社会优先”原则,行政任务与组织形态、资源配置、行政手段是否匹配,行政任务的履行程序是否合适等,都是组织效能原则对行政的组织进行检验的向度。但是,行政任务的去留难断、多元冲突、分解组合、先后位列、长短效应等复杂属性,给组织效能原则的适用带来挑战。加之行政的组织极具政治性和裁量性,组织效能原则宜定位为兼具实质内涵和开放、反思性质的行政组织法治原则。进一步,该原则应当得到配套的法规范化,从而发挥其应有的引导、调控作用。The connotation and significance of organizational efficacy principle,a basic principle of administrative organization law,have not been deeply explored.Introducing“administrative task”perspective can contribute to the refinement and standardization of organizational efficacy principle.The dimensions by which the organizational efficacy principle tests administrative organization include whether administrative tasks conform to the principle of“individual-market-society priority”,whether the administrative tasks match the organizational form,resource allocation and administrative means,and whether the procedures of implementing administrative tasks are appropriate etc.However,the complex attributes of administrative tasks,such as difficulty of deciding whether to stay or go,multiple conflicts,decomposition and combination,successively ranking and length effect,also bring challenges to the application of the organizational efficacy principle.Besides,how to organize administration is a very political and discretionary issue.Therefore,this principle should be taken as principle of administrative organization rule of law with both substantive connotations and open and reflexive nature.Furthermore,to play its due roles of guidance and regulation,this principle should be standardized by some supporting norms.
