摘 要:近年来,与游戏地图相关的著作权纠纷增多,其中以《穿越火线》案最为典型。当前学界主流观点认为应当依据个案中游戏地图的核心表达将其归入图形作品或美术作品范畴,但游戏地图与图形作品、美术作品的实质要求并不相符,强行纳入会带来体系性矛盾,同时其也不适宜以“其他作品”进行兜底。实际上,游戏地图不具有可版权性,其整体属于功能性设计,必然服务于游戏的可玩性本身,而并非传递设计者的思想情感。以著作权保护游戏地图并非规制当前深层侵权和“换皮”行为的妥当之举,最佳路径应是利用反不正当竞争法规制模式保护游戏地图设计者的商业竞争利益。The number of copyright disputes related to game maps has increased in recent years,among which the"CrossFire"case is the most typical.The mainstream view of the current academic circles is that game maps should be classified as graphic works or art works based on the core expressions of the game maps in the case,but the game maps do not match the substantive requirements of graphic works and art works,and their forced inclusion will bring systemic contradictions,and at the same time,they are not suitable to be underwritten by"other works".In fact,the game map is not copyrightable,and its whole belongs to functional design,which inevitably serves the playability of the game itself,rather than conveying the designer's thoughts and emotions.The best way to protect game maps by copyright is to use the Anti-unfair Competition Law to protect the commercial competition interests of game map designers.
