司法改革背景下法官助理制度研究

摘　　要：法官助理制度是人民法院员额法官制度的配套制度,当前实践中主要存在六个方面的问题:岗位吸引力不足、各法院法官助理配置比例迥异、养成路径不够成熟、法官助理对当前入额制度的认同感较低、工作质效没有统一的评价标准、职业发展前景不明晰。究其原因主要是招录门槛与职业前景不成正比、职能定位不清晰、缺乏系统的质效考核机制和激励递进机制、初任法官到基层法院任职制度与法官助理个体利益存在偏差、法官助理到基层入额与法官逐级遴选机制无法有效衔接、在职培养体系难以满足司法实践发展的需要。可以通过如下途径予以完善:提升法官助理岗位吸引力,赋予法官助理更加明确的定位,为法官助理顺利入额理清障碍,分类适用员额法官逐级遴选制度,针对法官助理建立系统的质效考核机制和激励递进机制,拓宽法官助理养成路径。The judge assistant system is a supporting system for the judges in the people’s courts.Currently,there are six main issues in practice:lack of attraction,different allocation proportions of judge assistants in various courts,immature career development paths,low recognition of the current salary system,lack of unified evaluation standards for work efficiency,and unclear career development prospects.The main reasons for these issues are the mismatch between recruitment standards and career prospects,unclear role positioning,no systematic performance evaluation and incentive mechanism,deviations between the appointment system for judges in grassroots courts and individual interests of judge’s assistants,ineffective connection between the appointment of judge’s assistants in grassroots courts and the hierarchical selection mechanism for judges;moreover,the current training system falls short in meeting the needs of judicial practice development.Those can be improved through the following measures:enhancing the attractiveness of the judge’s assistant position,providing clearer role definitions for judge’s assistants,removing obstacles for the smooth entry of the judge assistant,categorically applying the hierarchical selection system for judges,establishing a systematic performance evaluation and incentive mechanism for judge’s assistants,and diversifying the career development path for judge’s assistants.
