摘 要:PPP项目是促进经济发展的重要手段,但是近年来对于签订PPP项目的合同纠纷采取何种解决方式仍存在争论。关于PPP项目合同纠纷在国际商事中是否具有可仲裁性,我国现行的法律法规尚未明确规定,且司法实践中法院对PPP项目合同性质及纠纷类别的认定标准亦存在差异,通常会忽视该类合同纠纷的特殊性,进而造成难以执行仲裁裁决和无法保护社会资本方的利益等困境。PPP项目合同兼具民事性质和行政性质的双重属性,且因其产生的纠纷符合可仲裁性标准,即合同主体在履行合同过程中具有平等性,合同纠纷性质具有财产性,这些符合可仲裁性的标准。PPP projects are an important means of promoting economic development,but in recent years,there has been ongoing debate about how to resolve contract disputes that arise during the operation of such projects.Regarding whether PPP project contract disputes have arbitrability in international business,the current laws and regulations in China has no clear stipulation,and there are differences in the standards for determining the nature of PPP project contracts and dispute categories in judicial practice.Typically,the unique nature of such contract disputes is often overlooked,leading to difficulties in enforcing arbitration awards and protecting the interests of social capital providers.PPP project contracts have a dual nature,combining civil and administrative characteristics,and the disputes that arise from them meet the arbitrability standards,namely,the equal relationship between the contract parties in the contract performance process and the financial nature of the contract disputes,which align with the criteria for arbitrability.
