摘　　要：《中国法律与中国社会》(商务印书馆2010年版)的问题意识是剖析中国古代法律的基本精神与主要特质,却并不局限于此,更重要的则是通过法律的角度研究社会,通过中国古代法律的制度特性来管窥有关婚姻、家庭、阶级等广阔的中国社会图景,将法律传统与社会传统予以结合研究。该书有助于法律工作者回望中华法律在历史上走过的颠沛之路,从而感悟流消在现代法治血液里的本土文化基因。所以,单纯移植西方的法律制度进行中国的法治现代化是不切实际的,利用本土资源,重视传统和习惯建立现代法治才是历史的必然。The problem awareness of the book Chinese Law and Chinese Society(2010 edition by the Commercial Press)is reflected in its analysis not only of the basic spirit and main characteristics of ancient Chinese law.More importantly,it studies society from a legal perspective and glimpses the broad Chinese social landscape on marriage,family,class,and other aspects through the institutional characteristics of ancient Chinese law.The book combines legal traditions with social traditions for research.It helps legal workers look back at the turbulent road of Chinese law in history,and thus realize the local cultural genes flowing in modern law.Therefore,it is impractical to transplant western legal systems to modernize the rule of law in China.It is a historical necessity to use local resources,value traditions and customs to establish modern rule of law.
