摘 要:学理上,对于不动产登记审查标准的选择,在实质审查与形式审查的对立中逐渐模糊化,转而提出“合理的审慎审查标准”以回避争论。然而,“合理的审慎审查标准”本质上为一种附加于原有审查标准之上的“主观要件”,不具有独立适用性。审查标准的选择宜在遵循原有规范意旨下,对既有的实质审查路径进行修正,即对不动产物权变动中的主观要件免于审查,并明确登记机关在“法律事实清楚”时免于承担登记错误的赔偿责任。In theory,the selection of real estate registration review standards is gradually blurred in the confrontation between substantive review and formal review,and a"reasonable prudential review standard"is proposed to avoid controversy.However,the"reasonable prudential review standard"is essentially a"subjective element"added to the original review standard and does not have independent applicability.The selection of examination standards should be based on the intention of the original norms,and the existing substantive examination path should be amended,that is,the subjective elements in the change of real property rights should be exempted from examination,and it should be clarified that the registration authority is exempt from examination when the"legal facts are clear".Responsible for compensation for registration errors.
