对接国际高标准知识产权规则的思路与对策

摘　　要：当前,世界百年未有之大变局加速演进,国际经贸规则加速重构,相继涌现出以《全面与进步跨太平洋伙伴关系协定》(CPTPP)、《美墨加协定》(USMCA)为代表的国际高标准经贸规则体系,国际知识产权保护体系及法律框架也随之面临调整。从知识产权保护对接国际高标准规则的情况和特征看,我国不断完善知识产权保护体系,推动《区域全面经济伙伴关系协定》(RCEP)签署生效,但仍与发达国家之间存在规则差异,在对接国际规则和开展国际合作方面面临知识产权国际规则缺乏对标范本、霸权主义干扰知识产权国际合作等多重挑战。国际高标准知识产权规则是一个过程,我国应当更加积极主动地对接,参与知识产权全球的持续治理,争取发展中规则制定的主导权和话语权,依托高质量共建“一带一路”,推动构建更加开放包容、平衡普惠的知识产权国际规则。At present,the world is undergoing profound changes unseen in a century,and the international economic and trade rules are being restructured at an accelerating pace.A high-standard international economic and trade rule system,represented by the Comprehensive and Progressive Agreement for Trans-Pacific Partnership(CPTPP)and the United States-Mexico-Canada Agreement(USMCA),has emerged one after another,and the international intellectual property protection system and legal framework are also facing adjustments.China has continuously improved its IPR protection system and promoted the signing and entry into force of the Regional Comprehensive Economic Partnership(RCEP).However,there are still differences in rules between China and developed countries.In the field of international rules docking and international cooperation,we face multiple challenges,such as the lack of standard examples of international rules on intellectual property and hegemonism interfering with international cooperation on intellectual property.High-standard international intellectual property rules are a process,and China should be more proactive in connecting them,participating in the sustainable global governance of intellectual property rights,striving for the dominance and discourse power of rule-making in development,relying on high-quality co-construction of the"Belt and Road",and promoting the construction of more open,inclusive,balanced and inclusive international intellectual property rules.
