高校横向课题中的知识产权归属问题研究

摘　　要：横向课题是中国高校与企业协同创新的主要形式,对提升科技创新能力、促进科技成果转化发挥着重要作用。约定优先的权属配置模式用于横向课题中存在诸多困境,美、英、日三国校企协同创新中的知识产权归属模式提供了有益借鉴。基于对高校横向课题中法律关系的分析,提出横向课题的科技成果应纳入职务技术成果的范畴,原则上科技成果的知识产权应归高校所有,同时赋予委托方对科技成果的知识产权享有免费实施权,以实现高校与企业在横向课题中的利益平衡,助力中国高校科技成果赋权改革的有序推进。Crosswise projects serve as the main form for collaborative innovation between universities and enterprises in China,playing an important role in promoting China's technological innovation capabilities and fostering the commercialization of scientific and technological achievements.The application of the agreed-upon priority ownership model to crosswise projects has encountered numerous difficulties.The intellectual property rights ownership models utilized in collaborative innovation between universities and enterprises in the United States,the United Kingdom,and Japan offer invaluable insights for China.Following a comprehensive examination of the legal relationship in university crosswise projects,it is proposed that scientific and technological achievements of such projects should be classified as job-related technological achievements.The intellectual property rights should be vested in the university,with the commissioning party granted the right to exploit the intellectual property rights free of charge.This approach aims to maintain a balance of interests between universities and enterprises in crosswise projects and to facilitate the orderly progression of technological achievements empowerment reform in Chinese universities.
