机动车交通安全统筹协议的效力与法律适用——以两则裁判逻辑相反的法院判决为例

摘　　要：机动车交通安全统筹,是在交通运输系统内部开展的以服务交通运输安全为宗旨的一项行业互助制度。在其发展的过程中逐渐与行业互助的本质相背离而异化为同保险理赔业务趋同的逐利业务。关于机动车交通安全统筹协议,应承认其作为混合保险理赔内容与服务合同内容的混合合同的法律性质。在此基础上,不应以非法从事保险业务而否认其合同效力,只要不存在无效事由,应承认其作为一般民事合同的效力。对其内容适用上,首先应根据协议中当事人的真实意思确定权利义务,如果当事人没有约定,则应依据其性质分别参照适用保险合同与服务合同的相关规定确定当事人的权利义务,在参照保险合同的相关规定下,还应注重对被害第三者合法权益的保障,以更好彰显执法办案的法律效果与社会效果。Motor vehicle traffic safety co-ordination is an industry mutual assistance system which is carried out in the transportation system to serve the transportation safety.It gradually deviates from the essence of industry mutual assistance and alienates into profit-seeking business which converges with insurance claims business.As for the motor vehicle traffic safety co-ordination agreement,it should recognize its legal nature as a mixed contract of mixed insurance claims content and service contract content.Based on this,it should not be denied its contract validity for illegally engaging in insurance business.As long as there is no invalidity,it should be recognized as a general civil contract validity.In the application of its content,first of all,the rights and obligations should be determined according to the true intention of the parties in the agreement.If the parties do not agree,the rights and obligations of the parties should be determined by referring to the relevant provisions of the applicable insurance contract and the service contract respectively.Under the reference to the relevant provisions of the insurance contract,attention should also be paid to the protection of the legitimate rights and interests of the injured third party in order to better show the legal and social effects of law enforcement and case handling.
