国家监察立法领域的新命题——以政务处分法为线索的探析

摘　　要：细致透视政务处分法这一典型的国家监察立法,可以发现,我国的监察立法领域形成了一系列崭新命题。这些命题包括:监察立法以集成创制为基本立法模式,监察立法受到党纪的深度塑造,监察立法采用组织取向的价值定位,监察立法将道德问题纳入法律规制。监察立法领域形成的这些崭新命题,突破了传统的法学范畴,形成了一种全新的理论景观,体现了一种独特的法治逻辑。这些命题是在中国语境中形成的,它们扎根于当代中国纪检监察和权力监督实践,与中国历史传统和当代中国政治体系具有较高的匹配度。在推进当代中国纪检监察建设的过程中,应当认真对待这些命题,把握其深层内涵,使所构建的理论具有充分的实践指导价值。A close look at the PRC Law on Administrative Discipline for Public Officials,a typical national supervisory legislation,can find that a series of new propositions have been formed in the supervisory legislation in China.These propositions include the integrated law making as the basic legislative model for the supervisory legislation,deep influence of the party discipline on the supervisory legislation,adoption of the organization-oriented value positioning in the supervisory legislation,and incorporation of moral issues into legal regulations in the supervisory legislation.These new concepts formed in the oversight legislation have broken through the traditional legal categories and established a new theoretical landscape,embodying a unique logic of the rule of law.These propositions were formed in the Chinese context.They are rooted in contemporary China′s discipline inspection and power supervision practices,and are highly compatible with the Chinese historical traditions and contemporary Chinese political system.In the process of promoting the construction of discipline inspection and supervision in contemporary China,these propositions should be taken seriously with a solid grasp of their deep connotations so that the constructed theory will show sufficient practical value.
