摘　　要：翻译活动与意识形态并非无关,在帝国主义扩张过程中,其常成为殖民扩张和侵略的工具。但反抗殖民主义也可利用翻译活动,北洋时期《大理院判例要旨汇览正集》的英译便是典型案例,其将衍生于德日等国的民商法知识环流至英语世界,向世界展现了中国自清末变法修律以来新确立的民商法制度和司法现状。英译《汇览》是推动近代中国法话语重构的重要举措,一定程度上塑造了中国法的正面形象、打破了“法律东方主义”话语桎梏,使西方逐渐意识到中国民商法和中国司法制度的进步,对于北洋政府开展撤废治外法权运动而言意义重大。在筹备法权调查的过程中,《汇览》英译本起到了替代民法典接受调查的作用,成为调查法权委员会了解中国民事法律的主要依据。Translation activities are not divorced from ideologies.In the process of imperialist expansion,translation usually plays the role of a tool for colonial expansion and aggression.However,translation can also boost the resistance against colonialism.The English translation ofThe Chinese Supreme Court Decisions(《大理院判例要旨汇览正集》)in the Beiyang period is a typical endeavor.It circulated the knowledge of civil and commercial law derived from countries such as Germany and Japan to the English-speaking world,showcasing China’s newly established civil and commercial legal systems and judicial realities since the legal reform of late Qing Dynasty.The English translation ofThe Chinese Supreme Court Decisions is an important initiative to reconstruct the modern Chinese legal discourse,to a certain extent,shaping a positive image of Chinese law,breaking the shackles the discourse of legal orientalism,and gradually making the West aware of the progress in Chinese civil and commercial law and judicial system.This is of great significance for the Beiyang government’s movement to abolish extraterritoriality.In the process of preparing for the investigation of extraterritoriality,the English translation ofThe Chinese Supreme Court Decisions acted as the Civil Code to be investigated by the Commission on ExtraTerritoriality,becoming the main basis for the Commission on Extra-Territoriality to understand Chinese civil law.
