沿海工贸型城市商业方法专利布局与质量评价研究——以福建省为例

摘　　要：[目的/意义]实证沿海工贸型城市商业方法专利的布局特征与质量水平,为城市知识产权发展战略、区域创新发展战略的进一步完善和发展提供数据参考与决策支持。[方法/过程]在回顾商业方法发明的可专利性审查标准与规则演变的基础上,选取数字经济表现活跃的福建城市为研究对象,考察其商业方法专利的布局现状和政策环境;并根据专利布局形成各阶段的主体行为,构建了专利布局质量评价体系,对区域差异展开测度和解析。[结果/结论]福建商业方法专利布局总体呈现以福州、厦门为中心的双核心型布局,专利的创造质量和申请质量较好,但保护效果和运用效益普遍不佳,下一步应补齐短板在转让、许可、质押等多个专利运营环节提早布局、综合规划。[Purpose/significance]The paper studies the layout features and quality level of business method patents in coastal in-dustrial and trade cities􀆯and provides data reference and decision support for the further improvement and development of urban intellec-tual property development strategy and regional innovation development strategy.[Method/process]On the basis of reviewing the evolu-tion of patentability examination standards and rules for business method inventions􀆯this paper selects Fujian cities with active digital e-conomy as the research object to investigate the application status and policy environment of business method patents.According to the main behaviors of each stage of the patent layout􀆯the quality evaluation system of the patent layout is constructed to measure and analyze regional differences.[Result/conclusion]The layout of business method patents in Fujian generally presents a dual-core layout cen-tered on Fuzhou and Xiamen􀆯with good patent creation quality and application quality􀆯but poor protection effect and application benefit.The next step should be to make up for the shortcomings in the transfer􀆯license􀆯pledge and other patent operation links in advance layout and comprehensive planning.
