居住用地“合理自住”与“投资投机”的区分、设定与管理——关于完善城镇居住用地合理使用法律制度的思考

摘　　要：居住用地是住房的前提。资源有限,区分居住用地的“合理自住”与“投资投机”是落实“支持合理自住需求、遏制投资投机需求”的关键。基本居住用地和合理改善用地属于“合理自住”,超过这个范围就构成“投资投机”。居住用地的“投资投机”有极大的社会危害性,更违反了合理利用土地的基本国策和国家土地用途管制制度。为促进房地产平稳健康发展,必须完善城镇居住用地合理使用的管理制度:授权各地因城施策、对不同城镇的居民基本居住用地设定不同的保障标准,并将每个居民在全国所有的合理改善用地统一限定在各地基本居住用地保障标准的一定倍数范围之内;同时明确“保障基本居住、支持合理改善、限制奢侈消费、禁止闲置浪费”的具体措施。Residential land is a prerequisite for housing.Due to limited resources,distinguishing between "reasonable self occupancy"and "investment speculation"in residential land is the key to implementing "supporting reasonable self occupancy demand and curbing investment speculation demand".Basic residential land and reasonably improved land belong to the category of reasonable self occupancy",and exceeding this range constitutes "investment speculation".The social harm of "investment speculation"in residential land is extremely great,and it also violates the basic national policy of rational use of land and the national land use control system.In order to promote the stable and healthy development of real estate,it is necessary to improve the management system for the rational use of urban residential land.It is recommended to authorize various regions to implement policies based on the city,set different guarantee standards for the basic residential land of residents in different towns,and limit all reasonable improvement land for each resident nationwide to a certain multiple range of the basic residential land guarantee standards in various regions,At the same time,specific measures should be clarified to ensure basic housing,support reasonable improvement,limit luxury consumption,and prohibit idle waste.
